Abstract

Trust is a cornerstone of healthcare, particularly in the doctor-patient relationship, and it is crucial for effective healthcare delivery. Regulations comprising hard and soft laws are vital in maintaining this trust. The introduction of AI in medicine has raised concerns about its impact on this relationship, leading to a proposed tripartite trust model involving doctors, patients, and AI.

This thesis wants to contribute to creating a legal framework for the trustworthy use of AI in healthcare. To this end, the research addresses three key questions: identifying the essential building blocks for a legal framework to ensure trustworthy AI in healthcare, how these blocks influence each other, and what additional measures are needed to fill legal gaps.

Part I of the thesis (Chapters I-III) identifies the legal and conceptual foundations of trust in healthcare, introduces the impact of AI in healthcare, and describes the emerging legal framework for trustworthy AI. Part II (Chapters IV-VI) applies these concepts, focusing on the safety of medical AI, doctors’ evolving roles and responsibilities, and the communication dynamics between doctors and patients regarding AI use.

The conclusion synthesizes the findings, highlighting the essential legal framework for the trustworthy use of AI in healthcare and identifying areas for further research.
